Terms & conditions

How ordering works

Review items and quantities in your basket. Items can be changed or removed before checkout.
At checkout, choose your contact and delivery details, shipping method and payment method. Check and correct your details and order summary before submitting.
Only the final order/payment button at checkout submits your order. The basket’s checkout button only opens checkout.
An automatic receipt acknowledgement is sent by email after submission. The contract is formed when we expressly accept your order; a receipt acknowledgement alone is not acceptance.

These terms apply to artrarecards.ch. Nino Etter trades as ArtRareCards Etter and is the seller. The shop uses Shopify. There is no retail shop or collection facility at the address shown.

2. Accounts & details

Provide correct, complete and current contact, billing and delivery details. Protect your account access. Accounts must not be transferred or sold. Ordering requires legal capacity; minors need their legal representative’s consent where required.

3. Products & condition

The product description, language, condition and variant at the time of ordering apply. Colours and appearance may differ on screens. Information may be updated for future orders without changing agreed properties retrospectively. We may limit quantities. Products are intended for personal use rather than commercial resale.

4. Orders & contract formation

Submitting your order is an offer to buy. A contract is formed when we expressly accept it. An automatic receipt acknowledgement alone is not acceptance. Our shipping confirmation also expressly accepts your order, unless we have already expressly accepted it earlier. Payment must be received and processed before acceptance.

Before acceptance, we may decline an unavailable order or contact you to correct an obvious error. Payments for declined orders are refunded. Cancellation requests may not be possible after acceptance.

5. Prices & payment

Displayed prices for Swiss delivery are in CHF and include legally applicable taxes and mandatory charges. We deliver exclusively within Switzerland. Shipping prices, available services and conditions for card-only, box and mixed orders are in the shipping policy. Shipping costs and the final total are shown before submission. Checkout prices and conditions apply to your order. Available payment methods are shown at checkout. Promotions may have additional stated conditions.

6. Shipping

The shipping policy describes the delivery area, charges, processing and delivery times. Any specific times stated on a product apply to it. Delivery times are estimates unless expressly promised as binding. Check the address and contact us about loss, damage or a delivery problem. Statutory rules on risk and your rights apply.

7. Returns & exchanges

We offer a voluntary 30-day return right after receipt under the return policy, including its conditions, exceptions, return costs and refund deadlines. Mandatory statutory withdrawal and defect rights are unaffected and are not restricted by conditions for voluntary returns.

8. Defects & liability

Inspect your order on receipt and promptly report visible defects, damage or incorrect items. We investigate and agree the next steps with you. Agreed product properties and applicable statutory defect rights remain decisive. Liability follows applicable law. Liability for intent, gross negligence and other mandatory liability is not excluded. Mandatory consumer rights remain unaffected.

9. Acceptable use

Do not use the shop unlawfully, fraudulently, to infringe rights or transmit harmful software. Do not bypass security or impair operation with automated access. Access may be restricted for abuse without affecting statutory claims from accepted orders.

10. Content & intellectual property

Protected shop content must not be copied or used commercially without the necessary permission. Third-party brands and rights belong to their owners. You must have rights to reviews and other content you submit and allow us to use it in connection with the shop, subject to your personality and privacy rights. Unlawful content may be removed.

11. External services

External payment services and linked websites have their own terms. We do not fully control their content. Our obligations as seller remain unchanged.

12. Privacy

Shopify hosts the shop and processes browsing and order data. Enabled Shopify Network Intelligence may use information from this shop, other merchants and Shopify for enhanced services. Shopify and its providers may process data abroad. The privacy notice explains processing, recipients, countries and your choices. Contact us to exercise your rights.

13. Changes & validity

The terms applicable when the contract is formed govern your order. We may update them for future orders. An invalid provision does not affect the others where legally permitted. Not exercising a right does not automatically waive it.

14. Law & jurisdiction

Swiss law applies, subject to mandatory protective provisions of applicable law. Jurisdiction follows statutory rules. Mandatory consumer choices are not restricted by an exclusive Thurgau jurisdiction.
